Swartz Faces Up To 10 Years in Prison

MANSFIELD, Ohio — A man who quit as a Richland County commissioner two weeks ago has pleaded guilty to felony sex abuse involving a teenage girl

David Swartz, 66, of Shelby, pleaded guilty on Monday to two felony counts of sexual battery. He could be sentenced to up to 10 years in prison.

He appeared before visiting Judge Otho Eyster in Richland Common Pleas Court. He had told investigators earlier that the abuse of the girl, now 17, began when she was 6 or younger.

Prosecutor John Baker said the plea covered a four-year period.

“Both the victim and David Swartz agree they engaged in sexual conduct a number of times between January 2000 and January 2004, but, understandably, neither can recall specific dates,” Baker said. “Consequently, the time periods alleged in the charges cover the entire- four-year period.”

Baker said the abuse occurred in Swartz’s car and home.

Swartz, a potato farmer, resigned a commissioner Jan. 19, the same day he appeared in Shelby Municipal Court to plead innocent.

Investigators said the girl confronted Swartz using AOL Instant Messaging, an Internet chat program, and he told her not to tell anyone. An investigator was with the child at the time.

Swartz had filed for the Republican nomination to run for a third four-year term.
